شروط الإستخدام العامة
أهلا بكم في موقع أنترنت بياجيه (المسمى فيما يلي "موقع ويب") إصدار ونشر دار بياجيه ومقرها: 37 chemin du Champs-des-Filles, CH-1228 Plan-les-Ouates /Ge Suisse
يخضع استخدام هذا الموقع إلى الشروط المذكورة أدناه (والمسماة فيما يلي "الشروط") ويمكن لبياجيه أن تقوم من آن لآخر بمراجعة لهذه الشروط وتنقيح لهذه الوثيقة. تسري مفعول الشروط المنقحة على جميع المستخدمين في تاريخ عرضها على الشبكة. لذلك، يتوجب على المستخدمين استشارة الشروط بشكل دوري.

أنشأت بياجيه موقع ويب الحالي لتوفر للمستخدمين معلومات عن الشركة وعن منتجاتها لأغراض استخدام شخصي. يمكن للمستخدم أن ينقل نسخة معلوماتية أو يطبع نسخة عن مضمون موقع ويب الحالي لغرض شخصي، غير تجاري، تربوي، خاص أو في المنزل فقط، شرط أن تبقى المدونات الخاصة بالمالك، وبشكل خاص المدونات الخاصة بالملكية الصناعية مثل المدونات المسجلة والماركات التجارية ثابتة بدون تغيير أو إلغاء أو إتلاف. على المستخدم، ما اقتضى النص خلاف ذلك، أن يعتبر محميا حكما كل مايراه ويقرأه على موقع ويب من (رسوم، وصور، بما فيها الأشخاص في الصور، والإيقونات، والنصوص، وكليب فيديو والمضامين المكتوبة وغيرها) المسماة فيما يلي "مضمون بياجيه"، على سبيل المثال: إن حقوق نسخ وطبع التصاميم والماركات التجارية محمية في مختلف أنحاء العالم، بأحكام المعاهدات الدولية والقوانين الوطنية.
لايحق للمستخدم أن يبيع أو ينقل، أو يوزع، أو يغير، أو يعلن، أو يبلغ، أو يتلاعب بشكل عام بمضمون بياجيه، ولا يحق له استعادة أو تحضير بأي طريقة كان، لأعمال مشتقة أو انطلاق من شخص آخر على أساس مضمون بياجيه، كما ليس له الحق في استخدام مضمون بياجيه بأي طريقة كان لأغراض عامة أو تجارية. علاوة على ذلك، لايجوز إعلان مضمون بياجيه ولا نشره على موقع ويب آخر، في بيئة شبكة معلوماتية أو على أي وسيلة رقمية، لأي غرض كان. في حال مخالفة أي من هذه الشروط، تلغى إجازة استخدام مضمون بياجيه بشكل آلي بالنسبة للمستخدم والذي يتوجب عليه إتلاف أي نسخة نقلها من مضمون بياجيه . يمثل الإستخدام غير المصرح به لمضمون بياجيه مخالفة للقوانين فيما يخص النسخ، والماركات التجارية والمس بالحياة الشخصية وبالدعايات كما بالأنظمة والقوانين المتعلقة بالإتصالات. لاتسمح بياجيه باتصالات من مواقع أخرى على موقعها، بدون تصريحها المسبق والمكتوب.
عرض بيانات من قبل المستخدمين
تتعامل بياجيه مع كل اتصال غير مطلوب منها، أو مع أي مضمون يرسله المستخدم عبر موقع ويب، برسالة ألكترونية أو غيرها، باستثناء البيانات الشخصية القابلة للتحديد، بما فيها وليس فقط، البيانات، والأسئلة والأجوبة، والتعليقات والإقتراحات أو غيرها وكأنها بيانات غير سرية وليست مملوكة. يمنح المستخدم لبياجيه بإرساله معلومات إليها، رخصة بدون حقوق، دائمة، غير قابلة للنقض، وليست حصرية من حيث الإستخدام، والتصوير، والتغيير، والنشر، والإصدار، والترجمة، والتوزيع، والتنفيذ، والإعلان، وحدها أو كجزء من أعمال أخرى بأي شكل كان، وفي أي وسيلة كانت، أو تكنولوجيا، حالية أو مستقبلية، وتزويد الغير تحت رخصة مع حقوق. يمكن لبياجيه وفروعها استعمال كل مايرسله المستخدم لأي غاية كانت بما فيها وليس فقط، التصوير، والنشر، والنقل، والتعميم ووضع على الخط، والتطوير، والتصنيع، و تسويق المنتَجات التي تستعمل هذه المعلومات.
من جهة أخرى، إن بياجيه معروفة في العالم بأسره بتصميم ساعاتها ذات الجودة العالية وتصنيعها. لهذا الغرض تملك بياجيه مصادرها الخاصة الإبتكارية وبشكل خاص لديها فٍرق من المصممين من ذوي الكفاءات العالية، يصممون ويعدون ابتكارات بياجيه. وعليه، لا يمكن لبياجيه الموافقة أو قبول عروض بالتعاون لاتطلبها. في الواقع، لاشيء يمنع التصور بأن بوسع بياجيه وضع أفكار مماثلة. هكذا، تحرص بياجيه على إحاطة المستخدم علما بأن عليه الإمتناع عن تقديم عروض أو اقتراحات أو أفكار لها.
إعلان بشأن حماية الحياة الخاصة
وضعت بياجيه سياستها المتمثلة باحترام الحياة الخاصة نتيجة الثقة التي يمنحها لها زبائنها، وهذا طبق المعايير الصارمة الخاصة بحماية البيانات التي تتعهد بياجيه بمراعاتها.
تتم كل معلومة شخصية ترسل إلى بياجيه بشكل طوعي على أساس المعرفة والموافقة حين تقديم الطلب أو حين تقديم الإقتراح أو حين التسجيل للحصول على خدمات بياجيه. تتضمن نماذج التسجيل خانات إلزامية (يشار إليها بنجمة*) وخانات غير إلزامية. في حال اخترت عدم تعبئة الخانات الإلزامية لا يمكن لبياجيه أن تلبي الطلب أو تفعيل الخيارات التي تريدها.
إن المعلومات الشخصية التي تزود بها بياجيه تكون في متناول العاملين لدى بياجيه المخولين قانونا، وفي متناول أشخاص أو شركات، بشكل عرَضي، يؤدون عمليات داخلية ذات علاقة بنشاطهم. يخضع كل هؤلاء الأشخاص إلى تعهد تعاقدي بالسرية وباحترام الحياة الشخصية. تستعمل المعلومات الشخصية التي تقدمها لتقديم الخدمات التي طلبتها، وقد تستعمل لأغراض البحث والتسويق المرتبطة بأعمال بياجيه، وذلك من أجل نقل معلومات عن المنتجات وعن الأحداث التي تنظمها بياجيه.
باستثناء المعلومات الواردة أعلاه، لا تستخدم بياجيه بياناتك الشخصية في اتصالات غير مطلوبة، وتتعهد بعدم بيع أو تأجير أو توفير للغير البيانات الشخصية التي تسلمتها، باستثناء محاميي ومستشاري الدار وفي حال طرأ حكم قانوني أو قرار قضائي يجعل توفيرها ضروريا. تعمل بياجيه على تأمين الأمن للبيانات في أي لحظة.
في كل الحالات وعند الطلب، تلغي بياجيه بياناتك الشخصية من قاعدة بياناتها، وهذا مايلغي تسجيلك في مراكز خدمة بياجيه. إننا نحرص أيضا على إحاطتك علما وعند طلب خطي، بإمكانية اطلاعك على بياناتك الشخصية وطلب تصحيح بعض المعلومات الخاصة بك أو تغييرها أو إلغائها.

تقع قاعدة بياناتنا في سويسرا وتتم إدارتها فيها، وتخضع سياستنا الخاصة باحترام الحياة الخاصة إلى القوانين السويسرية وإلى تفسيرها، بغض النظر عن النزاعات في الأحكام القانونية. تخضع الإختلافات إلى قضاء المحكمة المختصة في كانتون جنيف، في سويسرا بشكل حصري.
إن بياجيه لعلى قناعة بأن سياستها تجاه حماية الحياة الخاصة تدل على تعهدها بإدارة بياناتك الشخصية طبق الإلتزامات القانونية المعمول بها، لحماية حياتك الخاصة بشكل كلي.
حدود الضمان
تقدم المعلومات على موقع ويب على سبيل المعلومات فقط. وتسعى بياجيه إلى ضمان تناسب المعلومات وشموليتها، لكن، ليس بوسع بياجيه ضمان أو الإدعاء بالضمان أن المضمون مناسب ولايخلو من خطأ أو أنه موثوق به أو أن استخدام مضمون بياجيه لايخالف حقوق الغير. يستخدم موقع ويب تحت مسؤولية المستخدم.

لاتمنح بياجيه ولا مزوديها أية ضمانة فيما يخص مضمون بياجيه، ونص البرنامج، والتحميل، والخطوط، والمواقع المتصلة أو فيما يخص النتائج التي تم الحصول عليها نتيجة استخدام موقع ويب. يرجى الإنتباه إلى أن بعض القوانين لا تسمح بالإستثناءات من الضمانات الضمنية، وعليه فقد لا تنطبق بعض الإستثناءات المذكورة أعلاه.
ملاحظة فيما يخص الماركات التجارية
بشكل عام، إن كل الماركات التجارية والشعارات وماركات الخدمات (المسماة بشكل جماعي "الماركات التجارية") التي تظهر في موقع ويب الحالي هي ماركات مسجلة أو لا باسم بياجيه، أو زُوّدت بها بياجيه من قبل الغير بموجب رخصة استخدام. أما الماركات الأخرى فهي ماركات مملوكة، وضعها مالكوها. وعليه، لا يمكن تفسير أي من المعلومات التي يتضمنها موقع ويب الحالي وكأنه يمنح بشكل ضمني أو غيره رخصة، أو حقا بالإستخدام لماركة موجودة على موقع ويب دون موافقة مكتوبة من بياجيه أو من الغير المالك للماركة. يمنع منعا باتا استعمال ماركات تجارية معلنة على موقع ويب أو أي مضمون لموقع ويب، إلا إذا نص العقد الحالي على حكم مخالف.
ملاحظة فيما يخص حقوق البيع والنشر
كل المعلومات الواردة في موقع ويب محفوظة الحقوق من حيث البيع والنشر والإستخدام 2005 PIAGET© أو أنها تحت رخصة استخدام لبياجيه. كل الحقوق محفوظة: يرجى الإطلاع على القسم الخاص في هذه الشروط العامة في باب استخدام المضمون الوارد أعلاه على موقع ويب.
صلات
يمكن أن تظهر على موقع ويب صلات بمواقع أخرى تحت إدارة الغير لاعلاقة لبياجيه بها. لايفترض إدخال صلة نحو هذه المواقع بأنها حظيت بموافقة بياجيه. لم تطلع بياجيه على كل المواقع التي لها صلة بموقعها ولا يمكن أن تتحمل مسؤولية مضمون أو ملاءمة الصفحات خارج موقعها أو أي موقع آخر مرتبط بهذا الموقع. يتحمل المستخدم مسؤولية الإطلاع على الصفحات خارج موقع ويب أو مواقع الغير.
إلغاء
يوافق المستخدم على أن لبياجيه إمكانية إلغاء أي اتصال وإنهاء استخدامه لموقع ويب إذا تبين لها أن المستخدم خالف (أو عمل دون احترام) لحرفية وروح العقد الحالي أو أنه خالف حقوق بياجيه أو الغير أو لأي سبب آخر، بإعلام المستخدم أو بدون إعلامه. يوافق المستخدم على أن بياجيه بوسعها تغيير أو توقيف نشر موقع ويب الحالي بعلم أو بدون علم. يوافق المستخدم على أن بياجيه ليست مسؤولة تجاهه أو تجاه الغير بسبب التغيير أو إيقاف نشر الموقع. تبقى أحكام الفقرات "حدود الضمان"، "حدود المسؤولية" و"أحكام عامة" سارية المفعول بعد إلغاء الشروط الحالية.
حدود المسؤولية
لا يمكن أن تتحمل بياجيه في أي ظرف كان ومهما كان السبب المسؤولية عن خسارة نجمت بسبب أو تعلقت باستخدام المعلومات المتوفرة على موقع ويب الحالي، بشكل مباشر أو غير مباشر بما فيه وليس فقط، فقدان ربح أو بيانات، أضرار جانبية، معينة أو غير مباشرة مهما كانت طبيعتها وعن العمل وإن كان العمل تعاقديا، أو جنائيا (بما فيه بسبب الإهمال) أو غيره، حتى ولو كانت بياجيه على علم بمخاطر الأضرار. ولأن بعض الدول أو البلدان لاتسمح بالإستثنائات أو بحدود المسؤولية عن الأضرار الجانبية أو غير المباشرة، يمكن ألا تنطبق هذه الحدود.
أحكام عامة

- (2) Any joint use of the Customer Information stipulated in 3(1) will be conducted within the scope of the purposes of use specified in 2(2). The Company will assume full responsibility for all requests for disclosure, amendment, deletion, etc. of the Customer Information to be jointly used. Customers should contact the customer service center shown in 6 to request disclosure, amendment or deletion of their Customer Information.
4. Provision of Customer Information to Third Party
- Other than as specified in 5(2), or unless otherwise provided by law, the Company will not disclose or provide the Customer Information to any third party without obtaining the relevant customer’s approval.
5. Management of Customer Information
- (1) The Customer Information provided will be appropriately kept and managed in accordance with the law of China.
- (2) The Company sometimes employs an external service provider to perform the processing or management of the Customer Information. In that case, the Company will take an appropriate partner at its responsibility and perform necessary and appropriate supervision over such service provider.
6. Customer Information Disclosure, Amendment or Deletion

The Company will assume full responsibility for all requests for disclosure, amendment, deletion, etc. of the Customer Information to be jointly used. Customers should contact the customer service center shown in 7 to request disclosure, amendment or deletion of their Customer Information.
4. Provision of Customer Information to Third Party
Other than as specified in 3 and 5(2), or unless otherwise provided by law, the Company will not disclose or provide the Customer Information to any third party without obtaining the relevant customer’s prior approval.

This notice describes the privacy policy of Piaget for customers residing in the Republic of China (Taiwan).
1. Privacy Policy
- Piaget, Richemont Asia Pacific Limited, Taiwan Branch (“the Company”) obtain personal information from each customer in accordance with Computer-Processed Personal Data Protection Law and other laws and regulations related to privacy protection and use the best endeavors to protect personal information by managing it in an appropriate and strict manner.
2. Use of Customer Information
- (1) The Company may ask customers visiting Piaget boutiques and the Piaget website to voluntarily provide personal information. The personal information provided, the records of the customer’s future visits, orders, purchases and repair orders, and any subsequent information provided by the customer either in addition to, or amending the existing registered personal information, will be hereinafter called the “Customer Information”.
- (2) The Company will use the Customer Information for:
- - Product and repair order fulfillment, and after service
- - Direct mail for announcing new products and events
- - Service improvement study
- - Internal market research
3. Joint Use of Customer Information
- (1) The Company will use the Customer Information provided by customers jointly among Piaget, Branch of Richemont Intl. SA and Piaget’s related group companies.
- (2) Any joint use of the Customer Information stipulated in 3(1) will be conducted within the scope of the purposes of use specified in 2(2). The Company will assume full responsibility for all requests for disclosure, amendment, deletion, etc. of the Customer Information to be jointly used. Customers should contact the customer service center shown in 6 to request disclosure, amendment or deletion of their Customer Information.
4.Provision of Customer Information to Third Party
- Other than as specified in 5(2), or unless otherwise provided by law, the Company will not disclose or provide the Customer Information to any third party without obtaining the relevant customer’s approval.
5. Management of Customer Information
- (1) The Customer Information provided will be appropriately kept and managed in accordance with the law of the Republic of China (Taiwan).
- (2) The Company sometimes employs an external service provider to perform the processing or management of the Customer Information. In that case, the Company will take an appropriate partner at its responsibility and perform necessary and appropriate supervision over such service provider.
6. Customer Information Disclosure, Amendment or Deletion
- (1) With respect to the disclosure of, amendment to or deletion of the contents of the Customer Information, please refer to the following customer service center:

- (2) In the case where a customer who has voluntarily submitted Customer Information to the Company does not interact or communicate with the Company for an extended period of time, the Company may delete Customer Information submitted by that customer and registered in the Company’s system. If the customer subsequently requests the Company for disclosure, amendment, deletion, etc. of their Customer Information after it has been destroyed, the Company will inform them of such fact.

1. Privacy Policy
Piaget North America, Branch of Richemont North America, ("Piaget" or referred to herein as "us", "our" or "we") a corporation organized and existing under the laws of Delaware, and having its corporate headquarters at 645 Fifth Avenue, 5th Floor, New York, NY 10022, U.S.A., takes the privacy of its customers seriously and has established its Privacy Policy in respect of the confidence its clientele places in it.
This Privacy Policy governs personal information we collect from our customers through the Piaget website and over the telephone.
2. Note to minors and children
No part of this site is directed to children under age 13 and we will not knowingly collect personal information from any child under age 13.
To register or place an order through the website or through the Piaget Concierge, you must have reached the age of majority (which in most states is 18 years old) and have legal capacity to enter into a contract. If you are under the age of majority or cannot lawfully enter into a contract, you must advice your parent or legal guardian to review this Privacy Policy and our Conditions of Sale before you register or place an order.
Should we discover or be informed that a child has registered his/her or another child's personal details, we will delete such information from our records.
3. Note to parents
Piaget will not intentionally collect personally identifiable information from children under age 18. 4. Telephone calls
All telephone calls to the Piaget Concierge may be recorded for security reasons and retained for a period determined by Piaget.
5. Personal information collection and use
In order to place an order through the website, you will be required to register and create an online account. During this process, you will be required to provide valid and up-to-date personal information, including but not limited to your real name, phone number and e-mail address, as well as other personal information as applicable, such as shipping address, billing address and payment details (collectively "Personal Information").
Should you contact the Piaget Concierge by telephone, you may also be required to provide such Personal Information.

7. Joint use of personal data
The following information will be used jointly by Piaget, Paymetric, Inc., who provides the on-line payment portal, and your credit card company to process payment of your order, and Accertify, Inc. who handle credit checks and fraud prevention:

- Your credit card information;
- The identification of the product(s) you have ordered; and
- The price paid for the product(s) you have ordered.
Your credit card company is responsible for their use of your Personal Information and should be contacted directly with regard to any matter regarding their use of your Personal Information.
All the information defined as your Personal Information will be used jointly by Piaget and other members of the Piaget group including Richemont International S.A., in Switzerland to ensure that your personal information is hosted in a secure environment.

Piaget is committed to protecting the security of your Personal Information.
We will employ all commercially reasonable measures to ensure that details of your order and payment are held securely. In the absence of negligence on our part, we shall not be held liable for any loss you may suffer if a third party procures unauthorized access to any Personal Information you provide to us via the Website or when ordering from Piaget by telephone through the Piaget Concierge.
9. Your rights
If you request disclosure, correction, deletion or that Piaget stop using your Personal Information, Piaget will deal with such requests in accordance with applicable laws and regulations. The deletion of your Personal Information or a request for Piaget to stop using it will result in the cancellation of your registration.
